The Right Way to Amend the Constitution, part 12

This is part twelve of an ongoing series of articles containing proposals for amendments to the Constitution. For someone who claims so fervently to be a “Constitutionalist”, how is it that I can be so eager to change the Constitution? Well, there are several reasons. For one thing, I believe that after the Bill of Rights, much damage was done by some of the amendments that were added and the legitimacy of some of their ratifications are questionable. Secondly, the Constitution has been violated so much that the necessity of further amendments is needed to resolve the resulting problems. But this should be done extremely cautiously. These amendments are extremely unlikely to ever be introduced, much less ratified, but hey, I can dream, can’t I?

I got this one from a well written article, The Kentucky and Virginia Resolutions: Guideposts of Limited Government, written by William J. Watkins, Jr. This is a fascinating historical account of the struggle to impose proper restraints on the federal government with particular respect to the Alien and Sedition Acts, which plainly denied Americans their first amendment right to freedom of speech over 200 years ago. It’s well worth the time to read and share with others this lesson from history, which illustrates the need for the following amendment, which was included in the article.

Section 1. The Constitutional Commission shall settle questions presented by the several States concerning the constitutionality of measures or actions taken by the government of the United States.

Section 2. The Constitutional Commission shall be composed of one Commissioner from each State chosen every second year by the people of the several States from two candidates chosen by the State Legislature, and the electors in each State shall have the qualifications requisite for the electors of the most numerous branch of the State Legislature; each Commissioner shall have one vote.

Section 3. No person except a natural born citizen shall be eligible to the office of Commissioner; nor shall any person be eligible to that office who shall not have attained to the age of thirty-five years, and been fourteen years a resident within the United States, and been nine years a resident of that State for which he shall be chosen. No person shall be elected to the office of Commissioner more than four times.

Section 4. When vacancies happen by resignation, or otherwise, during the recess of the Legislature of any State, the executive thereof may make temporary appointments until the next meeting of the Legislature, which shall choose two candidates to present to the people to fill the vacancy.

Section 5. The Constitutional Commission shall assemble at least once in every year, and such meeting shall begin at noon on the third day of January, unless they shall by law appoint a different day. The Constitutional Commission shall choose their Chairman and other officers. The Commission shall be the judge of the election returns and qualifications of its own members, and three-fourths of its members shall constitute a quorum to do business. The Commission may determine the rules of its proceedings. The Commission shall keep a journal of its proceedings, and from time to time publish the same.

Section 6. The Commissioners shall receive a compensation for their services, to be ascertained by law, and paid out of the Treasury of the United States. No Commissioner shall, during the time for which he was elected, be appointed to any civil office under the authority of the United States.

Section 7. Whenever the Chairman of the Constitutional Commission shall receive petitions from one-fifth of the legislatures of the several States requesting a ruling on the constitutionality of a specific measure or action of the government of the United States, the Commission shall convene. The act or measure of the national government shall be void and of no force if three-fourths of the Commissioners present vote against its constitutionality, or if three-fourths of the Commissioners from one section of the United States shall vote against the constitutionality of the act or measure.

Section 8. The three sections of the United States are defined as follows.

The Western Section shall be composed of Alaska, Arizona, California, Colorado, Hawaii, Idaho, Kansas, Montana, Nebraska, Nevada, New Mexico, North Dakota, Oregon, South Dakota, Utah, Washington, and Wyoming.

The Southern Section shall be composed of Alabama, Arkansas, Florida, Georgia, Kentucky, Louisiana, Maryland, Mississippi, Missouri, North Carolina, Oklahoma, South Carolina, Tennessee, Texas, Virginia, and West Virginia.

The Northern Section shall be composed of Connecticut, Delaware, Illinois, Indiana, Iowa, Maine, Massachusetts, Michigan, Minnesota, New York, New Hampshire, New Jersey, Ohio, Pennsylvania, Rhode Island, Vermont, and Wisconsin.

Whenever new States are admitted to the Union, the Commission shall make the necessary modifications to the sectional compositions.

Section 9. The Constitutional Commission shall not sit as a Convention as prescribed in Article 5 of the Constitution of the United States.

Bob Barr, DOMA and the LP's Big Tent

There are many members of Libertarian Party who don't hold to all of the positions in their platform, particularly on the issues of abortion and the Defense of Marriage Act (DOMA). Bob Barr, their 2008 presidential candidate, voted for the Patriot Act and the 2002 Authorization to use force in Iraq. Though he has changed his mind about these two issues, falling in line with LP platform (sort of). But the former Republican congressman is still at least nominally pro-life which goes directly against it. But what I recently found out that was most stunning of all is that Bob Barr actually authored DOMA! That's really weird to me that they would specifically say that they are against a particular piece of legislation and then nominate the author of that legislation to be their presidential candidate. That's even more incredible than the fact that Bill Clinton signed it into law. What strange bedfellows!

Many LPers think that they will be perceived as so much more "libertarian" by saying that DOMA is big government. They are just trying to make themselves look like they are better than the Democrats when it comes to "civil rights". They think that DOMA will lead to federal agents pulling down couple's pants to make sure that there is only one of each gender. (Its been thirteen years and it hasn't happened yet.) Come on, guys, it's about state's rights, not an expansion of federal power or "victimless crime" legislation.

ObamaCare: The $900 Billion Lie

GOVERNMENTAL MALPRACTICE

Last evening in the President’s speech to the joint session of Congress clarified very little for me in regard to the Democrat’s Health Care Reform proposal or ObamaCare for short. His invocation to the 'sainted' Senator Edward Kennedy’s passionate pursuit of socialistic health care reform until the bitter end, did not sway me one iota. The President’s repeat of his promise that his health care reform would not add to the deficit and that it would ONLY cost $900 billion was laughable. I have heard much higher estimates.

I gathered that he would pay for the health care through driving fraud and abuse from the Medicare Program . . . and other details still to be worked out. He said that he would not ration Medicare. He said he would protect Medicare.

The President lied when he said that healthcare WAS our deficit problem. No, wasteful government spending – including TARP, the bailouts, the stimulus package, the bloated federal budget, the ridiculous Cap and Trade bill, and now ObamaCare – are the real causes of the ratcheted increases in our deficit. He, more than healthcare costs, is the primary reason for our increasing deficit.

The President lied when he said that his healthcare reform was not a government takeover of healthcare, 1/6 of our economy. He claimed his intent was not to put insurance companies out of business, but that he just wanted to hold insurance companies accountable. I ask then, who will hold the President and Congress accountable for the wasteful out of control spending?

I do not believe the President when he said that there will be no insurance coverage provided for illegal aliens. A great number of members of Congress groaned in disagreement at the assertion that illegal aliens will not be covered.

I do not believe the President when he said that no federal money will be used to pay for abortions. This is a technicality, somehow, somewhat those abortions will be paid for – maybe by private premiums.

The President said that federal conscience clauses to protect healthcare workers from having to assist in morally reprehensible procedures. Isn’t his administration working to negate or overturn the George W. Bush executive order establishing protection for the conscience clause?

The President stated that those opposed to reform would do so at any cost. We who oppose ObamaCare do not oppose healthcare system reform, we oppose the ObamaCare, government-run, Universal Healthcare, Single Payor, Socialized Medicine approach to reform!

The President accused Governor Sarah Palin assertion that ObamaCare would create Death Panels for allocating care to the elderly, if not my name, by implication that ObamaCare would not establish death panel or healthcare rationing. Healthcare will be rationed and the elderly will be short-changed under ObamaCare.

The President said that he would not sign any healthcare reform plan that would add to the deficit. Then he is either lying or has misjudged the cost of ObamaCare with its public healthcare insurance option.

Again the President calls anyone opposing ObamaCare ‘special interests.” He is calling the majority of Americans ‘special interests’.

MEDICAL MALPRACTICE

In what appeared to me to be a bone thrown toward the Republicans, the president said that he has instructed the Secretary of Health and Human Services to begin immediately to pursue Medical Malpractice Reform pilot projects. This was the single responsible thing that the President said in his speech last His in evening. The rest was merely a regurgitation of HB 3200, American’s Affordable Health Care Plan.

Here is an email I sent to radically liberal Democratic Senator Sherrod Brown in regard to medical malpractice insurance:

Thank you for the opportunity to ask you a question regarding health care reform on your Electronic Town Hall to be held on Thursday, September 10th, 2009 from 6:30 -7:15 PM.

Last evening, in the President’s address to the Joint Session of the House and Senate, he seemed to acknowledge the fact and the need to reform medical malpractice insurance.

Do you agree with the need to significantly reform medical liability and to deter junk lawsuits and to put a cap on awards – in order to reduce the cost of healthcare through exorbitant medical malpractice premiums that many physicians have to pay today – and is what drives more and more physicians from the practice of medicine?

This had previously been an area none of the Democratic proposals seemed to address.

Liberties or Lies?

I, for one, will be counting the untruths that our alleged President Barry Soetoro a/k/a Barack H. Obama proclaims during his speech tomorrow evening to the Joint Session of Congress. In an apparent desperate move, the president and his teleprompter will try to sway the congressional members still on the fence to vote his way (or else).

The American people have been fooled badly by this man in November 2008. After the spending spree we have witnessed after Inauguration Day, I think the jig is up. Soetoro/Obama is a European Socialist/would-be third world type dictator disguised as a genuine American. That disguise is getting more exposed. This summer, Americans, as evidence by TEA Parties, Town Halls, phone calls, letters, birthday cards, and other forms of protest, have tried to tell the President and Congress that the majority of Americans DO NO WANT the complete redo or makeover of the American Health Care System because of the maybe 12-15 million people who do not have adequate coverage. Certainly there are less costly and less destructive ways to correct this problems of the truly uninsured.

Like I said, I will be trying to enumerate the lies that will be told in tomorrow evening Presidential address. Certain lies, which will again be perpetrated, will be that 45-48 million are now in need to be helped because they are uninsured. Another lie is that the opposition party does not have any solutions to offer. Another lie is that abortion and euthanasia will not be included as mandates in the so-called reform package. Another lie to look for is that you can always keep your current health insurance plan. This is only temporary, at best. You can keep it as long as it does not change. Once it changes you are obligated to take on a the government mandated plan or benefit package.

This president's spending ways are out of control. This government, which is in power, like every totalitarian state before it, lusts to control every facet of its peoples lives. They are like leaches sucking the life blood, the freedom, from red-blooded, free Americans.

So I will be watching and counting the lies in the President’s final attempt to salvage a severely flawed and freedom-sapping redo. If ObamaCare or some iteration thereof ever passes, it will ultimately lead to destruction of the American Health Care System we have come to expect and for so long have taken for granted along with our liberties.

The Principal-in-Chief speaks to ‘His’ Children Tomorrow

I read the nearly 2,500 word prepared back to school speech which the White House released today and will present to students in classrooms across America tomorrow. I also read an insightful article, “Obama: First Father, Chief Principal, and Head Psychologist,” written by Dr. Herbert W. Titus.

Here are a few comments about the upcoming speech and the article mentioned above. In the speech the President states, “(Y)our government’s responsibility for setting high standards, supporting teachers and principals, and turning around schools that aren’t working where students aren’t getting the opportunities they deserve.” The federal government has assumed a role that the U.S. Constitution does not authorize. Education is NOT the role of the federal government. It is primarily the individual school districts and parents responsibility. Through the years the federal government has usurped more and more ‘responsibility’ for what amounts to indoctrinating our children. The graduation rate and test results are woeful in comparison to other industrialized nations. Why? The ineffective curriculum subverted by the leftist political-oriented teachers unions and the incompetent heavily layered bureaucratic federal and state departments of education. The real solution is return local authority to schools and parents, end union monopolization and encourage school vouchers and alternative teaching venues in place of the worst government-run schools.

Reading between the lines, our leftist president subtly pushes his beloved homosexual agenda with these words, “Maybe you’ll decide to stand up for kids who are being teased or bullied because of who they are or how they look, because you believe, like I do, that all kids deserve a safe environment to study and learn." “Teased or bullied because of who they are” is code for homosexual and other alternative lifestyles, which his administration and the leftist teachers unions continue to force on the education system and on the unsuspecting children of America. They are more concerned in placating this tiny moneyed minority than they are in educating our children.

The most egregious, arrogant and egotistical remarks that the President will make tomorrow is this, “I’m working hard to fix up your classrooms and get you the books, equipment and computers you need to learn.” What about the taxpayer, Mr. President? You seem to be expert in spending other peoples’ money. You cannot even acknowledge the source of the funding you so willingly, so lavishly, so wastefully with little or no accountability dole out to favorite leftist political cronies and causes. Who messed up the classrooms in the first place, Mr. President? It was the godless secular humanists who threw God and the Judeo-Christian Bible out of the schools in the 1960s and replaced it with a secular humanistic state religion. The results include falling grades, Columbine, increase in drug usage, gangs, lack of morality and virtue. I hate to inform you, sir, you cannot replace God no matter how wise and enlightened you may think you are.

There are a few things the President does say in his wordy speech about responsibility, goals and working hard, but that does not take two thousand words to say. The money spent on making that broadcast happen could be much better used in providing school vouchers or returning money to individual schools to use where needed most. I am afraid your propagandized pep talk isn’t really needed. It will merely put the kids to sleep.

One of the best quotes from the Herb Titus article mentioned above is, “Increasingly the hallmark of the Obama presidency is that nothing is outside of his official authority as President of the United States. From the car business to health care, and from the Cambridge, Massachusetts, police department to a Florida lady’s desperate need of food, clothing and housing, President Obama has assumed the role of president as busybody.” Well put, the President is sticking his nose into places he does not belong. Meddling with the free market in banking, housing, car manufacturing, energy, healthcare and now education.

One final quote from Dr. Titus, “Under the tutelage of this President’s totalitarian vision of his office, the educational bureaucrats will not stop with their political agenda, but will do everything in their power to impose their secular irreligious beliefs upon the hearts and minds of the children in violation of the First Amendment’s prohibition against an establishment of religion.” As I stated earlier the religion, the creed of Secular Humanism and its amoral principles has replaced Christianity and its moral principles. The president is a avid proponent and a leading evangelist of Secular Humanist doctrine and indoctrination. This may be his first foray into the schools, but don’t expect it to be his last. He is, or at least acts like he is now the Principal-in-Chief along with CEO of GM along with being the media’s chose messiah . . .

How is the President doing being ‘My Brother’s Keeper’?

During his presidential campaign candidate Barack Hussein Obama, then even after becoming President, spoke several times of the need of being his brother’s keeper. How well has this champion of the downtrodden succeeded in fulfilling his mission?

THE LEAST OF THESE

On one of his first days in office, President (Barry Soetoro a/k/a) Barack Obama signed an Executive Order (EO) cancelling the Mexico City Policy, which had restricted funding of foreign abortions, reversing President Bush's EO. Then in another early Executive Order the President issued, he authorized the federal funding of Embryonic Stem Cell Research. According to the advisors in the Obama Administration, embryos are not human: therefore, he is not harming his brother.

All abortion, according to President Obama, is good and unborn human look alikes are not human. So there is no harm done by abortions. Abortion survivors are to be allowed to die. Discarding unwanted substances for women is not Obama harming his brother.

IT’S ALL RELATIVE

President Obama’s father’s son is living on twelve dollars a year in Kenya. As far as I know President Obama has done nothing to help him. Those who would help him are kept away from him. At least President Obama hasn’t killed him as Cain killed Able.

Cain was the first to use the phrase “my brother’s keeper.” God said to Cain, “what have you done?” “Your brother’s blood cries to me from the ground.” To this Cain replied, “Am I my brother’s keeper?” The question is then, ‘Is Obama his brother’s keeper?’

FUELING THE ECONOMIC COLLAPSE

The President has increased the National Debt by two and a half trillion dollars in less than one year. This has lead to stock market declines, unemployment, and in the future, high inflation. But, the nation is not his brother.

FUNDING DOMESTIC TERRORISTS

Four billion dollars was budgeted for ACORN, a radical organization which is often found cheating in elections. Two billion dollars of the United States Treasury was also given to a Brazil oil company to drill for oil in the ocean. George Soros, the financier behind much of the Leftist movement, has an eight hundred million dollar investment in the company. It would appear that these are the brothers Obama is keeping.

CODDLING FOREIGN TERRORISTS

The term 'War on Terror' has been eliminated by the administration and detainees are being released with their housing paid for at government expense. American military in the field are given rules of engagement, which keep them from engaging the enemy.

CONCLUSION

It would appear that the brothers President Obama is keeping are his political supporters, financial supporters,and the terrorists.

This is definitely a change from the Bush Administration. However, it is a change with which we cannot stand!

"Dear Leader" Plans to Address the Schoolchildren of the Nation September 8

In those materials not only was it clear that only one perspective on sexual perversion was be given to students - that it is "good", of course - but the curriculum went so far as to identify Christian denominations as "enlightened" or "unenlightened" depending on their position regarding this issue. As a reviewing judge noted,

He will also call for a shared responsibility and commitment on the part of students, parents and educators to ensure that every child in every school receives the best education possible so they can compete in the global economy for good jobs and live rewarding and productive lives as American citizens.

The “Pledge” to Dear Leader is Real Creepy, Chilling . . .

I think the people in this embedded video below are Hollywood types or celebrities of some sort. However, I don’t really recognize many of them, except maybe one guy did look like Mike Tyson. In any case, I do not regard what they say as any more important or relevant than any of the other 330 million American. Actually, I don’t regard these “pledges” as anything more than leftist or socialist propaganda.

This video is way creepy. Furthermore, it seems to be an extension of Barry Soetoro aka Barack Obama’s ’08 campaign for president. Unfortunately campaigning is just about the only thing that Dear Leader does well. He sure has demonstrated great incompetence in governing this nation in driving up the national debt and trying to alienate and divide our peoples.



Apparently this awful video was shown at a school assembly somewhere in Utah recently. It is a shameful self promotion of a socialist President with an ego the size of the world, produced and performed by equally egotistical and elitist socialists. It is political propaganda and has no place in this country's schools. The president is not a king, a monarch, he is not to be served. He is a public servant. He is the one that is meant to serve the people.

Ten Ways to Improve Healthcare in America

I mentioned in a previous post the Barack Obama made the statement that no one is offering any alternatives to the “healthcare crisis” in America. I agree with him that we need change. I agree with him that the majority of the Republicans are offering no real solutions to the problem. But the real solution is radically different from either his plan or what the majority of the Republicans are saying. Here are 10 alternatives to more government and higher taxes:

First of all the government itself makes too many mandates on private insurance companies. They are not allowed to offer “incomplete” coverage. This means you have to pay for coverage for things (pregnancy care, alcohol addiction recovery programs, etc.) even if these things do not at all apply to you. So you already have partially socialized healthcare even if you only have private insurance. They have laws which prevent the sale of insurance across state lines. Why? Just to drive up costs so that the insurance companies can make more money. But getting rid of the insurance companies is not the answer. Then you will be paying for someone else’s risky behavior though your taxes (you already are, but with H.R. 3200, it will be more so). But getting rid of these mandates would save you 20% to 50% on your healthcare.

Secondly, we need to get rid of all of these incentives for employers to offer healthcare. When we do this, even more mandates are placed on the terms of the plan and the costs go up even more. The employee usually just takes the plan, even though it is wasteful, just to get a deduction on his taxes or because there is no better alternative because the government regulations have driven all the good insurance companies out business.

Thirdly, the attitude of the populace needs to change drastically. You wouldn’t buy car insurance that pays for your gas, minor repairs, oil and tire changes, would you? If the extra cost for the insurance was far more than the cost of the extra services you would receive (even though “free”), you would be getting a bad deal. People need to start paying out of pocket for routine healthcare services and prescription drugs rather than being on some plan, even if it is private, which covers every little thing. That is why the “little things” cost so much. You don’t care how overpriced things are if your insurance company is the one paying for it. You also won’t care how much things cost if the government is paying for it. But this is just an illusion; you are really paying for it through higher premiums and/or taxes. Insurance should be used only for catastrophic costs. Such insurance would be more readily available and cheap if wasn’t for government interference.

Fourthly, government regulations already stifle competition by imposing price controls on healthcare. If a doctor chooses to accept Medicare cases, he is forced to charge the same amount of money for all procedures covered by Medicare. No matter how much better one doctor is at performing a procedure than another, they both have to charge the same price. This discourages good healthcare practices. My understanding of H.R. 3200 is that it would go a step further and not only make this requirement for all doctors, but would make their wages uniform. Socialism takes away incentives to perform tasks well.

Fifthly, the FDA contributes to the high cost of prescription drugs. We need to stop them from banning imported drugs and taking perfectly good drugs off the market. The cost of their expensive drug efficacy regulations is passed on to the consumer. (It costs $1 million just to submit the paperwork for these tests, and much more for all the research that needs to go into it, most of which is unnecessary.) Even the drugs that eventually do make the market are always held up for many years. The supposed purpose of these regulations is to prevent the drug from being sold to people who don’t really need them. But doctors often get around this by prescribing them for “off-label” purposes. The FDA also discourages people from using natural alternatives. The FDA is working for the drug companies, not us.

Sixthly, why not just stop taxing healthcare and health insurance? That would also save us a ton of money.

Seventhly, the government regulations are already so complicated, the insurance companies and healthcare providers must spend lost of extra money on lawyers and paper pushers so that they can comply with the law. They pass the costs on to you, or worse yet, go out of business, leaving less competition which increases prices even more. Simply obeying the Constitution and getting rid of federal healthcare regulations would save us another ton of money.

Eighthly, state licensure laws also raise costs. They are supposed to protect the consumer against unqualified healthcare workers. These laws actually raise the cost of healthcare by increasing healthcare worker shortages. The expenses of those entering the field are increased, making it cost prohibitive for those of low income. Because of this and all of the other frustrating regulations, many people chose other occupations or retire earlier.

Ninthly, the government has no business having access to your medical records. This discourages people from seeking the health care that they need, resulting in the subsequent need for more expensive treatment. H.R. 3200 would make this even worse.

Finally, every involvement of the Federal government in healthcare (except for providing for veterans and military personnel) is unconstitutional (read the 10^th amendment). Why try to fix something that is so inherently wasteful and illegal?

There are several bills that you can tell your congressman to support to achieve these ends. H.R. 2629, The Coercion is Not Health Care Act simply says, “Participation in, or access to, any program of the Federal Government or eligibility to receive any benefit under Federal law shall not be conditioned on the purchase or maintenance of health insurance coverage. No individual or agency of the Federal Government shall ever require any individual to purchase health insurance coverage.” H.R. 2630, The Protect Patients and Physicians Privacy Act is also a good bill that would do what it says. H.R. 3217, Health Care Choice Act of 2009 would loosen restrictions on selling health insurance across state lines. Finally, H. J. RES. 48 is a proposal for a Constitutional amendment which would prohibit government from engaging in any business activities not specified in the Constitution (including healthcare) and would shut down all such engagements within a period of three years, sell all assets related to these activities, and abolish federal income taxes so that this never happens again.

Republicans Do Not Enough Backbone To Stop Socialized Medicine

This is a perfect example of how Republicans have lost all credibility with the public. Even if Mike Pence really said "government takeover of" instead of "government run" healthcare, he like most Republicans, is caught with his tail between is legs. I pick on Pence a lot, not because he is worst of the Republicans, but to show how bad off we really are because he is one of the best. This is a perfect example of how power corrupts people. They start out with good intentions, but because of pressure from within their political party and from a deceived populace, they all but sell their own grandmothers down the river.

Medicare is a socialized, government takeover of healthcare for senior citizens. It isn't just an "option". In some ways, it is even worse than Obama's plan because it actually is mandatory. The Republicans are hypocrites. When they had control over all branches of the federal government, what did they do? Remember the presciption drug expansion of medicare? Another socialistic Bush healthcare expansion besides the Prescription Drug Plan is the MEDICARE ADVANTAGE Plan. This also passed while the Republicans still controlled everything. This was a huge expansion of government over the healthcare of senior citizens. Basically, it is free healthcare for seniors. The "public option" is already here, folks. Costs always go up whenever you make something "free". No need to praise our healthcare system for how good it is to disuade people from supporting Obama's plan. You need to, rather, tell how BAD it is to convince your congressman not to vote for H.R. 3200. The majority of the Republicans are being intellectually dishonest in this debate and are offering no real solutions. Yet, when Obama says that NO ONE is offering any alternatives to solve the current crisis, HE is also not being intellectually honest. I will discuss the real solution to this mess in a future post.

The Right Way to Amend the Constitution, part 11

This is part eleven of an ongoing series of articles containing proposals for amendments to the Constitution. For someone who claims so fervently to be a “Constitutionalist”, how is it that I can be so eager to change the Constitution? Well, there are several reasons. For one thing, I believe that after the Bill of Rights, much damage was done by some of the amendments that were added and the legitimacy of some of their ratifications are questionable. Secondly, the Constitution has been violated so much that the necessity of further amendments is needed to resolve the resulting problems. But this should be done extremely cautiously. These amendments are extremely unlikely to ever be introduced, much less ratified, but hey, I can dream, can’t I?

Here is another proposed amendment (subject to revision):

After the first enumeration, required by the first article of the constitution, there shall be one representative for every thirty thousand, until the number shall amount to one hundred. After which the proportion shall be so regulated by Congress, that there shall be not less than one hundred representatives, nor less than one representative for every forty thousand per-sons, until the number of Representatives shall amount to two hundred, after which the proportion shall be so regulated by Congress, that there shall not be less than two hundred representatives, nor less than one representative for every fifty thousand persons.

There were originally 12 amendments in the proposed Bill of Rights. This amendment was one of the two that didn’t get enough votes to be ratified with the others. The other one, having to do with limits on congressional pay raises, was finally ratified in 1992 and became the 27^th amendment.

I think that this amendment is a good idea because it, along with repealing the 17^th amendment, would bring the Congress “closer to the people”. It’s harder to hold them accountable if they represent such a large population.

A disadvantage of this amendment would be that the states would no longer have as much “say” in the Presidential elections. (The Presidential elections would be much closer to a “popular vote”.) But if we followed the Constitution, we would still much further away from a democracy than the true constitutional republic that we are supposed to be.

Let's Get 'er Done: ObamaCare Health Care Rally - Columbus

About 1,500 die hard (and that's even before ObamaCare or KennedyCare becomes effective!) Democrats from the heavily Democratic Columbus area attended a pep rally of sorts at the Ohio State Fairgrounds in Columbus this evening. Can you imagine having to pay $5.00 per car to protest the presence of Constituent-Avoiders like U.S. Senator Sherrod Brown, U.S. Congresswoman Mary Jo Kilroy and Columbus Mayor Michael Coleman? That is exactly what I had to pay to park my car at the Fairgrounds. Inside the large Senator Lausche Exhibition hall KoolAide was being consumed by the gallon by probably the same people who were mesmerized last fall to vote for the second coming of J.C. (that's Jimmy Carter, your you non-religious folks).

Senator Brown was in his element, a controlled crowd of gushing adorers, unlike the 900 some people he avoided a week or so ago in his home town at a Health Care and Cap and Trade Town Hall held at the Mansfield Senior High School. He and his fellow Democrats had hoped that no one reads the bill. However, the genie is out of the bottle and more and more folks are reading it and not liking what they read.
