The voting results so far indicate around 97% in favor of one of the three options. Take the poll and see the results for yourself. Gun ownership is but another one of the liberties this current administration and current Congress are trying to confiscate.
This is part six of an ongoing series of articles containing proposals for amendments to the Constitution. For someone who claims so fervently to be a “Constitutionalist”, how is it that I can be so eager to change the Constitution? Well, there are several reasons. For one thing, I believe that after the Bill of Rights, much damage was done by some of the amendments that were added and the legitimacy of some of their ratifications are questionable. Secondly, the Constitution has been violated so much that the necessity of further amendments is needed to resolve the resulting problems. But this should be done extremely cautiously. These amendments are extremely unlikely to ever be introduced, much less ratified, but hey, I can dream, can’t I?
In lieu of writing a new proposal for a Constitutional amendment, I will further comment on the one I posted last week, The Audacity of Legitimacy Amendment. Click here to read it in its entirety.
I have a few comments on Section 4, which says, “The House of Representatives shall, within 48 hours of the ratification of this article, select a President in the manner described in Article II section 1 Clause 3 and elsewhere in this Constitution as if no Person had received a majority of votes in the last Electoral College in Dispute. The President so selected shall be elected to complete the remainder of the term held by the de facto President.”
The House could not just pick anybody to fill out the remainder of Barack Obama’s term. In fact, if this amendment were to be ratified in during Mr. Obama’s alleged first term, then I believe John McCain (unfortunately) would become the President. This is because he is the only one who received any legitimate electoral votes for President. In both Article II section 1 Clause 3 and the 12th Amendment, the House is limited to the “persons having the highest numbers [of electoral votes] not exceeding [five in Article II and three in the 12th Amendment] on the list of those voted for as President”. I would assume that “voted” refers to the Electoral College vote and that if someone did not get any Electoral College votes, then they are not “on the list”. I could always add additional conditions, but I would rather have as little interference with what the Constitution already says as possible.
If this Amendment were to pass while Mr. Obama illegally holds the office of the Presidency and after the next the Presidential election day, but before the Electoral College vote, and if he was reelected (in the Electoral College vote), then 20th Amendment would apply. In this case, Obama’s running mate would act as President beginning January 20th, 2013 and “until a President shall have qualified”. If the amendment passes in Obama’s second (usurped) term, then the conditions in the previous paragraph would prevail, with those receiving electoral votes in 2012 being voted on by the House. The 20th Amendment would also be applied in the case that John McCain died or if he became ineligible. In that case, Congress “may by law provide…declaring who shall then act as President, or the manner in which one who is to act shall be selected…”
The first portion of Section 5 is intended to cover the unlikely case in which the only eligible Presidential candidate is also the Vice President. That would mean, for example, Joe Biden would be removed from office and the vacancy would be filled by John McCain (at Obama’s choice). Since the election of Joe Biden is relatively legitimate, he should be left in office.
But that brings up an interesting point. Even though Joe Biden’s eligibility to become Vice President is not in question, the actual manner in which he was elected is somewhat questionable. In some states, a Vice Presidential candidate is not eligible to receive electors if the other member of ticket is not eligible. This makes some, but not all of Joe Biden’s electoral votes illegitimate. I’m not going to take the time to find out if he would still have had enough votes to beat Sarah Palin. (The Electoral College ballots for President and Vice President are distinct according to the 12th Amendment. If any of Biden’s votes are illegitimate, these votes would all presumably go to Palin.) But the current wording of my amendment overrides all of this, making Joe Biden’s election official (if he is in fact, the de facto Vice President at the time that the amendment is ratified or similarly if another running mate or Vice President was subsequently chosen by Mr. Obama).
Finally, I want to explore a little bit about what would happen if Mr. Obama were declared ineligible and my amendment did not pass. Ordinarily, if a law is passed by Congress and if the President does not sign it in so many days, then it becomes law just as if he did. But what if there is no President? Is Joe Biden our real President (by the 20th Amendment)? Even if this is so, there have been other actions taken by Mr. Obama (such as executive orders) which are illegal since he is not our President. These would have to be dealt with in some way.

I attended the Proclamation March this last Sunday afternoon at the Bulldogs Roadhouse Restaurant. This event was in support of the right to bear arms. The main speaker was Rand Paul, son of Ron Paul and likely candidate for the U.S. Senate in Kentucky in 2010. (The incumbent, Jim Bunning has just dropped out of the race according to Fox News.) I am not ready to endorse him yet, but probably will once I find out all of his positions on the issues. Anyone in Kentucky who wants to vote for him (or any other Republican) in the 2010 primary must be registered as a Republican by December 31, 2009. Great speech and answer session, Rand!
Speeches were also given by Ian Grumbine, Brenda Wehrman, and Kentucky Gubenatorial candidate Gatewood Galbraith. Tennessee Gubenatorial candidate Carl “two feathers” Whittaker could not make it.
Liberal Senator Lindsey “I’m a conservative, but I’m no Ron Paul” Graham has once again proven that voting for a Democrat isn’t always the liberal thing to do.
Here is what I mean by this:
Graham, a member of the Senate Judiciary Committee, joined with Democrats in voting for the most liberal Supreme Court justice nominee ever. Sotomayor is so liberal, that she believes not only that a woman has a legal right to choose to have abortion, but that it is a constitutional right to have an abortion for free (paid at taxpayer’s expense). So even if Congress never passed any law in which funds for abortion were appropriated, she would say that women should sue to have their abortions paid for by the taxpayer and she would rule in their favor. Graham is continuing a long line of liberal, sell-out Republicans who have voted for extremist liberal Supreme Court justices. (A case in point, John McCain voted to confirm both Ruth Bader Ginsburg and Steven Breyer to the Supreme Court.) In the 2008 general election, Graham defeated a true pro-life, pro-peace, pro-liberty Democrat, Bob Conley. Who cares if there are 60 Democrat senators? With Republicans like these, they might as well all be Democrats.

The discussion regarded the recent U.S. Senate Judiciary vote that recommend Sonia Sotomayor be sent to the entire sent to be voted on for confirmation as Supreme Court Justice. Hat tip is due to NewsBusters.com for the following excerpt of the interview transcript. I was very impressed with Michelle’s quick wit and concise critique of Lindsey Graham.
LAUER: After the, the last election it was said that the Republicans need to broaden the tent, they need to reach out to minorities. Reach out to Hispanics. Is that, are those six "no" votes gonna hurt Republicans down the road?
MALKIN: No, because they were six principled votes AGAINST RACIAL PREFERENCES and the idea that somehow IDENTITY POLITICS has a place on the court of law.

The things that Malkin said about Graham holds true for Ohio’s George Voinovich, Maine's Olympia Snowe and Susan Collins, Indiana’s Dick Lugar and Arizona’s John McCain. All six are unprincipled pandering, wishy-washy, politically correct moderate liberal RINOs, who cannot be trusted as true conservatives on very many important issues.

Over the lunch hour I caught a few minutes of the Rush Limbaugh Radio Show. He played a few clips of Governor Palin’s Farewell Address in Alaska, which she made on Sunday. I was impressed with some of the sound bites. I listened to the entire speech and want to highlight a few of the more stunning and powerful remarks. She did the speech without the aid of a teleprompter, by the way.

And then this allows that very generous VOLUNTARY hand-up that we can known for, enthusiastically providing for those who need it.” Whether she runs again for political office or not she will be an effective voice for conservatives to the bane of Liberals across the nation. She'll tell it like it is and help put traction to the Tea Party Movement . . .

MY OVERALL ASSESSMENT OF THE SPEECH
Overall, I find Sarah Palin to be Reaganesque and so refreshing in her positive upbeat approach to political challenges and issues that we face. What a stark contrast to the negative, crisis-oriented, fear-based, America-hating, enemy-appeasing that so characterizes the current occupier of the White House and our lame Congress and its Congressional 'leaders'.
This principle that President Reagan enumerated is one of the main themes of the growing Tea Party Movement spreading like wildfire throughout the U.S.A.!

The Browns state, “Obama's mad rush for revenue to fund his social engineering has transformed his agenda into a war against the middle class.” The first strike against the middle class was based on the fallacious man-caused climate change hoax, Cap and Trade Bill. The Cap and Trade (or, more fittingly, Cap and Tax) Bill kills jobs, raising utility and gasoline and related expenses of the middle class. How else will he pay for his insanely expensive and unnecessary health care reform proposal, accurately referred to as, ObamaCare, merely a regurgitation of the failed HillaryCare proposition?
Barry Soetoro a/k/a Barack Obama and his wife, Michelle, seem to be flaunting their position as first couple. In the face of economic collapse, job loss the Soetoro/Obamas are living ostentatiously high on the taxpayer provided hog, pizza or whatever. “. . . (E)ven worse than his overt elitism, is the damaging effect his agenda is having on middle-class taxpayers . . . (giving) only lip service to helping the middle class,” say the Browns.
They conclude their very insightful article stating, “Obama is moving away from the free-enterprise economy that provided the middle class with jobs and unprecedented buying power. Obama and an army of White House Czars don't create prosperity -- they just eat it up. Future taxpayers are going to have to pay for all these programs and deficits, and the middle class will end up shouldering the load, while Obama is enjoying his gold-plated government retirement.” If, America survives, and that is a big 'if,' then I see a hopefully, one-term Soetoro, alias Obama, globe-trotting and interfering in the affairs and best interests of America ala Jimmy Carter for many years to come. That is not a pretty picture.

My Response:
The following is an unabridged version of my response to the question above. The economy stands a much better chance of recovery if the current Congress and the current occupier of the White House will not implement ObamaCare, the nationalization of our health care system.
Reform IS necessary. Let’s start with putting a cap on Malpractice claims. Let’s allow the purchase of insurance across state lines. Let’s offer tax credits for Health Care Premiums for both employees and businesses. Let’s reward and encourage preventive medicine. Let’s allow the insurance companies to offer an array of policy options instead of mandating certain benefits that may not be needed. Let’s penalize those who abuse themselves through drugs, alcohol, food, promiscuous sexual behavior, etc. Why should society pay for immoral and unhealthy behavior?
I liken this to the current cable TV offerings. I will not subscribe to any cable or satellite TV option until they allow me to select only the channels I want. I do not want to support the trash that you get when you subscribe to any of their current offerings.
States mandate certain insurance coverage this should be up to the market place to determine. Get government out of health care. Medicare should be privatized.
I had the day off on Thursday, July 23rd, so I took a trip to Cleveland, Ohio, which was where President Soetoro alias Obama visited the Cleveland Clinic and later Shaker Heights High School. It was at the school that the President held another propaganda session (disguised as a town hall meeting). The rain came down in sheets of rain for a portion of the drive up to Cleveland. By the time I arrived the heavy rain subsided.
I arrived a bit late to the ObamaCare protest that emanated from Shaker Town Square, which proceeded down Lee Road to Shaker Heights High School. Before I caught up with the 400-500 or so ObamaCare protesters, I caught a glimpse of President Soetoro aka Obama’s motorcade: 4-6 motorcycle, 8 black SUVs and a couple of limousines. I unfurled my soggy sign, hoping the man would see it. It read, “ObamaCare: It’s to die for.” I had "Where'stheBirthCertificate?" on the reverse side.
Several streets were barricaded so I ended up walking quite a bit. My sign was getting more and more soaked.
I met people from all over Ohio including Cincinnati and Stubenville and Cleveland. Some of the protest signs were quite illustrative. This was another TEA Party Action event. The Tea Party Movement is growing, because more and more people are awakening as to what this President and this Congress are trying to do to America.

My Response:
With or without government mandated or funded abortions, I oppose ObamaCare. I oppose ObamaCare on principle. It is unnecessary, wasteful, free-enterprise killing, socialistic, inefficient and ineffective. It is socialized medicine.
One needs only look to see what Congress and the past Presidents have done to Social Security and to Medicare to see failure by big government to steward such a massive program. It would be beyond foolish to trust the government to fix health care.
Health care does need reform, but it does not need the proposed detonation of the present system, replacing it with something far worse. By mandating abortion funding and end of life rationing it makes ObamaCare even morally reprehensible in addition to the fact that it would be a financial fiasco.

My Response: Yes, indeed, the last six months this nation has raced towards its DESTRUCTION. We are on a spending spree, with the apparent goal of bankrupting this nation. Instead of fixing our economic problems, Congress and the President have chosen a course that exacerbates the problems. Also, what they are doing (Stimulus, Bailouts, nationalization of industry, etc.) would turn this nation from a constitutional republic with limited government, capitalism, and free enterprise as the chief drivers of the economy, into a socialist state modeled after the Soviet Union with big government bureaucracy and collectivism as the main drivers of the economy.

The SHOUT heard ‘round the world TAKE BACK the 2nd AMENDMENT

At the historically named location of Independence Kentucky on 2015 Declaration Drive (20-minutes from downtown Cincinnati ), a Constitution-inspired 2nd Amendment “Proclamation March” will occur on Sunday, 2 p.m. July 26th to commemorate the “Shot heard ‘round the world.” People from Ohio , Kentucky and even Tennessee will be attending.
On the rally’s website, http://www.takebackthisnation.org/ which contains more information about the event, organizer Brenda Wehrman writes: “Many know this story from their history books – but what we weren’t told is that this proclamation of liberty ‘heard ‘round the world’ started because the British were coming to confiscate their weapons.” This statement is followed by a quote from George Washington: “Firearms are second only to the Constitution in importance; they are the peoples' liberty's teeth” contrasted by a rather provocative quote from Vladimir Lenin: “One man with a gun can control 100 without one.”
In an interview, Brenda Wehrman says, “Citizens all across America are clearly concerned that their rights may be in jeopardy because every gun store owner I talk to tells me that they can’t seem to keep enough ammunition in stock.” This is depicted in a short movie she directed to highlight the upcoming “Proclamation March.” The movie can be seen at the website and has a cast of local volunteer actors. The main character, Ian Grumbine, goes back in time to the evening of April 18th when he finds he is Paul Revere visited by a founding father who spurs him to take his Midnight ride to warn the colonists of the advancing British army.
Speakers from both sides of the aisle will address the rally including Dr. Rand Paul who is running for the Senate in Kentucky and Gatewood Galbraith , Kentucky Gubernatorial candidate. This is part five of an ongoing series of articles containing proposals for amendments to the Constitution. For someone who claims so fervently to be a “Constitutionalist”, how is it that I can be so eager to change the Constitution? Well, there are several reasons. For one thing, I believe that after the Bill of Rights, much damage was done by some of the amendments that were added and the legitimacy of some of their ratifications are questionable. Secondly, the Constitution has been violated so much that the necessity of further amendments is needed to resolve the resulting problems. But this should be done extremely cautiously. These amendments are extremely unlikely to ever be introduced, much less ratified, but hey, I can dream, can’t I?
The title for this week’s proposed article of amendment (subject to revision) is The Audacity of Legitimacy Amendment, the text of which follows:
Section 1: For purposes of this article, the termElectoral College in Dispute shall refer to the Presidential vote of the Electoral College on December 15, 2008 and all other Electoral College votes in which Barack Hussein Obama was chosen by at least one Elector.
Section 2: For purposes of this article, the termde facto shall refer to what would be the case in regards to the result of the election of the President if the result declared by the presiding officer at the Joint session of Congress certifying anyElectoral College in Dispute had been in accordance with the Constitution in regards to the natural born citizenship of Barack Hussein Obama.
Section 3: Thede facto President shall be removed from the office of President and shall cease acting as President immediately upon ratification of this article.
Section 4: The House of Representatives shall, within 48 hours of the ratification of this article, select a President in the manner described in Article II section 1 Clause 3 and elsewhere in this Constitution as if no Person had received a majority of votes in the lastElectoral College in Dispute. The President so selected shall be elected to complete the remainder of the term held by thede facto President.
Section 5: If the Person selected as President in section 4 of this article is thede facto Vice President at the time of the ratification of this article, the Senate shall chose by ballot a new Vice President. The Vice President so selected shall be elected to complete the remainder of the term held by thede facto Vice President. Otherwise, thede facto Vice President shall be the Vice President.
Section 6: Any law enacted by the United States, action in the capacity of President taken by thede facto President, or action taken by the United States under orders from thede facto President acting in the capacity of President, while he wasde facto President shall become inoperable 30 days from the ratification of this article unless affirmed by the President selected as prescribed by section 4 of this article within 15 days of this selection to the Presidency.
Section 7: If a Person other than Barack Hussein Obama holds the office of President at the time of the ratification of this article, then sections 3, 4, 5, and 6 of this article shall be inoperable and all laws enacted by the United States, all actions taken by Barack Hussein Obama in the capacity of President, all actions taken under orders from Barack Hussein Obama while acting in the capacity of President, and all Presidential election results with respect to anElectoral College in Dispute shall be as operable as if Barack Hussein Obama had been elected to the office of President in accordance with the Constitution.
Section 8: Barack Hussein Obama shall never hold the office of President or Vice President at any time subsequent to the ratification of this article.
Commentary on this proposed amendment:
I believe that it explains itself pretty well. It would inadequate to impeach Mr. Obama at this time, since that would leave all the legislation that he has signed into law and other actions in limbo as far as whether or not they are to be recognized as legitimate. Besides a Constitutional amendment, a fifty state secession is the only other remedy that I can think of to resolve this perplexing question.
I was tempted to put in something that would say that if Mr. Obama were to come up with a birth certificate and if it would be upheld as authentic in the Supreme Court, then the whole article would become inoperable. But the fact that his inaction on the issue is in itself a violation of the Constitution and that he has violated the Constitution in many other ways, he deserves to be impeached even if he really is, in fact, a natural born citizen. Furthermore, it would complicate things as far as what should happen if some of the terms of this amendment were carried out and then the birth certificate came forth.
Section 7 is regrettable, but necessary so that if the amendment did not pass until many years had passed, there would not be continuing disputes about the legitimacy of Mr. Obama’s actions taken under the guise of being President of the United States. The main point of this article is to ensure that drastic consequences don’t take place as a result of this situation.

I found this excellent letter on a posting by a contributor to the Cleveland.com National Politics forum. I reproduce it here, because it encapsulates my sentiments as well. Apparently this was a letter to the Editor of Stars and Stripes, a military publication.
Not a God-given right
To the writer of "Era of not trusting gays over" (letter, July 6): I would say that while he is free to voice his opinion, his argument is invalid.
Homosexuals are not forbidden from drinking from the same water fountains as others, or segregated from restaurants and schools, or denied the right to vote. Therefore, homosexuality cannot be viewed as a civil rights issue.
Homosexuals claim their rights are hindered because they cannot serve openly in the military. I say strongly that military service is not a God-given, inalienable right. It is a privilege, one that those who volunteer for it hold dear. It is an honorable profession with a proud history.
Like [in] nearly all institutions, there are requirements to join and remain within it. If one does not meet those requirements, or violates the established rules and regulations, then that person can be deemed unfit to be part of the organization.
Additionally, to suggest that Dr. Martin Luther King Jr. included gay rights in his movement for equality is outrageous. He was a Christian man of great faith, and I find it impossible to believe that he did not view homosexuality as morally repugnant.
Homosexuality is a chosen behavior. King hoped that people everywhere would judge each other not by skin color, but by their character. The writer contradicts himself when applying it to gays because homosexuality is part of one’s character. Therefore, I judge it to be immoral and unacceptable behavior, and will raise my children to view it the same.
The military is among the few institutions remaining that promotes and stands for morality and good order, and I sincerely hope that elected officials and lawmakers everywhere and at all levels will keep it that way, instead of catering to the whims of a mere few for the sake of votes.
