MASSIVE Peaceful NON compliance will STOP it!



On its very face, this is also a flagrant violation of the 5th amendment. Any census form that goes beyond asking how many people live in the residence is a violation of the 5th amendment, and court cases have established this, yet the census becomes more and more invasive each time.

Declaration To Make To Census Takers:
"I hereby affirm that the provisions of Title 13 ....requiring me to disclose my race, personal financial data, birth date, or any other personal, private information to the Bureau of the Census, and agency of the United States government, constitutes an unreasonable, unwarranted search of my person, house, papers, and/or effects, and a governmental invasion of the sanctity of my home and the privacies of life. As such, these provisions violate the Fourth Amendment of the USConstitution, and are wholly void and I am not bound to obey them.
I have completed only those sections of the Census form pertaining to the Constitutionally-mandated actual enumeration, as follows:
1. The actual number of people living at the address printed on the form, excluding untaxed Native Americans;
2. Age of each person in accordance with US Const. Amendment XIV, Section 2;
3. Sex of each person in accordance with US Const. Amendment XIV, Section 2.
I have thus fulfilled my obligation to the attainment of the actual enumeration of the populace of the United States.
Any fine or other sanction that is levied by any office or organization stemming from the unconstitutional provisions of Title 13 in connection with my response to this or any other Census-related questioning will be challenged in a court of law."

Articles of Freedom, part 6



This is a series of posts concerning the works of the 2009 Continental Congress. Two weeks ago I wrote about Article 4 of the Articles of Freedom, which was about the last ten words of the First Amendment, the right to petition the government for Redress of Grievances. Now I will continue with Article 5, the text of which follows. I completely agree with it, though I think it would be very hard not to do business with corporations which require SSNs. ARTICLE 5.

PRIVACY AND THE FOURTH AMENDMENT

From November 11th to the 22nd of 2009, the Continental Congress convened pursuant to the People’s formal “Petition of Redress of Grievances” relating to the violations of the Peoples’ Rights of Privacy guaranteed to them under the 4th, 5th, and 9th Amendments. After deliberation and discussion of the abuses of the Rights to Privacy, this Body provides:

A. REMEDIAL INSTRUCTIONS TO THE FEDERAL GOVERNMENT

1. Repeal the so-called Patriot Act and its progeny.

2. Repeal any other law that is repugnant to the 4th, 5th and 9th Amendments.

3. Stop the collection, storing, and dissemination of private information of a non-criminal nature belonging to the People; WE, the Free People of this nation, are not the enemy.

4. Furthermore, we demand the retraction of any intelligence reports maintained by the Department of Homeland Security, not properly cited and sourced as well as any intelligence report known to contain plagiarized information.

5. Repeal of NAIS (National Animal Identification System) which requires the RFID (Radio Frequency Identification) of all livestock (animals) and mapping the premise of same.

6. Cease the implementation of acts such as the REAL ID Act of 2005, the PASS Act of 2009, and make no future attempts at implementing a national ID card or authorizing any funding associated with said acts.

7. Do not collect, process, store or disseminate intelligence of a non-criminal nature.

8. Repeal all laws that collect fingerprints, blood, or DNA upon birth.

B. REMEDIAL INSTRUCTIONS TO THE SEVERAL STATES

1. Retract any Fusion Center intelligence report not properly cited and sourced as well as any intelligence report known to contain plagiarized information.

2. Reject the so-called Patriot Act, and its progeny.

3. Prohibit legislation that allows for the installation of red-light cameras and other devices used to surreptitiously gather information on American citizens. Repeal any such existing laws.

4. Repeal any legislation that requires government permission to travel, i.e., the requirement to obtain a driver’s license to travel, the requirement to register one’s vehicle, and/or the requirement to purchase motor vehicle insurance unless the vehicle is being used for commercial purposes.

5. All state governments shall cease and desist in prosecuting those men and women who are using the public right-of-way for personal, non-commercial transportation.

6. The language “for commercial purposes only” shall be added to the definitions of the terms “transportation” and “motor vehicle”, in all state laws, clearly removing the restrictions imposed on travel for personal, private purposes.

7. Repeal of all state laws that collect fingerprints, blood, DNA, or any other biometric data for minor traffic violations, infractions, or for any other instance where said data is not necessary for investigation.

8. Destroy all biometric data, whether digital or tangible, that have been collected for use with a driver’s license, or for any other purpose not related to a felony investigation.

C. RECOMMENDED CIVIC ACTIONS BY THE PEOPLE

The Delegates of the Continental Congress of 2009 wholeheartedly support and encourage the Free People of each state to engage in the following:

1. Visit www.cc2009.us and click on the Privacy Reference List, study all information provided in that list, and act in their best interest according to the information provided;

2. Inform themselves about the police and surveillance state that is being created in America in direct violation of the 4th, 5th, 9th, and 10th Amendments;

3. Submit open records requests to the appropriate agencies requesting the items listed below. Consider coordinating these efforts with other activists;

a. Copies of all Memorandums of Understanding (MOU's) between participating Fusion Center agencies and any other party, agency, organization, institution, governmental body or individual that relates to Fusion Center information/data sharing;

b. Copies of Fusion Center Privacy Policies;

c. Copies of all Strategic Reports produced by or received by said Fusion Centers, including the distribution list and citations for each produced Strategic Report; to include identification of the authoring agency of any received Strategic Report;

4. Expose the findings of said open records requests through online social media, existing liberty media, liberty-minded organizations, and other means of public dissemination;

5. Approach fellow citizens and groups to build an issue-based coalition in order to lobby local and state government to ensure that:

a. Unless directly involved in a crime, no private sector entities will be involved in the operation of Fusion Centers;

b. Only data and intelligence concerning federal crimes may be made available to any federal agency;

c. Fusion Centers are not to be used to conduct surveillance on an entire group based on the presence of one suspicious individual;

d. Ensure the creation of a "privacy committee" to oversee the privacy policy of your local Fusion Center and ensure compliance;

e. Ensure compliance with CFR 28, part 23;

6. Lobby your state legislature to nullify the Patriot Act;

7. Implement a Community Response Hotline; the People are encouraged to develop alternative means of communication, i.e. ham radio, short wave, or any other means of electronic communication;

8. Be aware that no citizen is required to release their social security number and should not release it if there is an alternative method;

9. Conduct business only with companies that do not require a social security number;

10. Use non-traceable forms of currency (i.e. prepaid credit cards) and non-traceable technology (i.e. prepaid cellular phones);

11. Use open-source software solutions, encrypt their computer hard drives, and use proxy servers when connected to the
Internet, for computer security and privacy reasons;

12. Understand that everyone, including the government may record photos and video on public property;

13. Read licensing software agreements and be aware of the privacy ramifications of signing up for such services;

14. Promote local and state legislation that forces local and state governments to further scrutinize the process of accepting
grants or other funding concerning surveillance and the militarization and federalization of local police departments from
Federal Agencies such as the Department of Homeland Security and the Department of Justice;

15. Lobby for a local resolution banning red-light cameras or other surveillance equipment in public areas.

Furthermore, without delay, the public is advised to contact their state and local representatives to open up a dialogue to assure that they repeal and propose no further legislation that violates the Privacy Clauses of the Constitution. Americans should also contact their local sheriff and demand they uphold their sworn oath or affirmation to protect and defend the Privacy Clauses of the Constitution.

Third Party Candidates Unite








Having lost the bid for the Republican nomination for president, Ron Paul has made it clear that he will not run for president as an independent. But three days ago, he set up a press conference with presidential candidates Ralph Nader, Chuck Baldwin, and Cynthia McKinney. Each candidate (including Bob Barr, who did not attend the event) agreed to a set of political principles, which go against principles that both Barack Obama and John McCain have espoused. The statement of these principles is below. Though Ron Paul says not to vote for either O’Cain or McBama, he does not officially endorse any of these four candidates. I don’t endorse any of them either, but I would rather have any of them as president than either of the two republicrats. Here are their campaign websites:

At the press conference, mention was made of a website which promotes the idea of voting for third party or independent candidates rather than the “lesser of two evils”. The idea is that someone leaning towards voting for McCain, but only because he thinks Obama is worse, could make a deal with someone who thinks that Obama is the lesser of two evils. They would both agree to vote for a third party candidate instead. Someone might say, “But how can I trust the person with whom I am making this deal that they will really vote for the third party candidate instead of Obama or McCain?” The website addresses this issue in several ways, but there is one that I find to be both very helpful and intriguing. BOTH YOU AND YOUR “VOTE BUDDY” WOULD FILL OUT ABSENTEE BALLOTS AND MAIL THEM IN AT THE SAME TIME! What a great idea! You can read more about this here.

Here is the set of principles on which the four candidates agreed:

We Agree

Foreign Policy: The Iraq War must end as quickly as possible with removal of all our soldiers from the region. We must initiate the return of our soldiers from around the world, including Korea, Japan, Europe and the entire Middle East. We must cease the war propaganda, threats of a blockade and plans for attacks on Iran, nor should we re-ignite the cold war with Russia over Georgia. We must be willing to talk to all countries and offer friendship and trade and travel to all who are willing. We must take off the table the threat of a nuclear first strike against all nations.

Privacy: We must protect the privacy and civil liberties of all persons under US jurisdiction. We must repeal or radically change the Patriot Act, the Military Commissions Act, and the FISA legislation. We must reject the notion and practice of torture, eliminations of habeas corpus, secret tribunals, and secret prisons. We must deny immunity for corporations that spy willingly on the people for the benefit of the government. We must reject the unitary presidency, the illegal use of signing statements and excessive use of executive orders.

The National Debt: We believe that there should be no increase in the national debt. The burden of debt placed on the next generation is unjust and already threatening our economy and the value of our dollar. We must pay our bills as we go along and not unfairly place this burden on a future generation.

The Federal Reserve: We seek a thorough investigation, evaluation and audit of the Federal Reserve System and its cozy relationships with the banking, corporate, and other financial institutions. The arbitrary power to create money and credit out of thin air behind closed doors for the benefit of commercial interests must be ended. There should be no taxpayer bailouts of corporations and no corporate subsidies. Corporations should be aggressively prosecuted for their crimes and frauds.

Medical Privacy Law Nets No Fines

Here is a year old article about medical privacy that I have found interesting. This is just another example of the increasing lawlessness in this country. Making laws and then not enforcing them not only makes this country an undisirable place to live, but it makes God angry. People use privacy as an excuse to legalize abortion, but people who don't want to murder their babies don't get legitamate privacy rights.

Is justice really blind in our courts?

I was on jury duty last week. After being transferred from the Grand Jury to the Petit Jury, I was called with 15 other potential jurors to a courtroom for Voir Dire. Eight of us sat in the jury box and eight sat behind the litigants. The judge asked us if we knew any of the litigants or any lawyers in the case or any lawyers that worked for the same law firm as any of the lawyers in the case. The case was a civil lawsuit, having to do with an automobile accident and medical bills which were allegedly caused by the accident.

Then the plaintiff’s attorney asked if anyone had sued, been sued, had an injury that required surgery, had physical therapy, and other such questions. If anyone said yes, then they asked more specific questions, some very personal. He also asked more questions about any connections to the legal profession that anyone had. One man said his brother was a lawyer and another juror was a legal secretary.

The defense attorney kept asking us a question about whether or not we would think that it is possible for someone to exaggerate an injury in order to win a case. The plaintiff’s attorney kept objecting, and the defense attorney kept rephrasing it. A side bar was called, the defense attorney rephrased the question again, and the plaintiff’s attorney objected again. This was an obvious ploy by the defense to plant an idea in our heads. He knew that it would be objected to and sustained.

Each lawyer seemed to try to act like they didn’t know what they were doing in order to gain our sympathy, clamoring for every inch of advantage. How pathetic.

Then the defense attorney asked us more such questions. He asked me about my occupation. I gave a technical answer about what I do (I am a scientist). One juror asked to speak with the lawyers and the judge in private and when they were done, the judge said that this juror was dismissed “with cause”. One of the other eight potential jurors was called to replace him. Then each attorney grilled this juror as they had done us.

Each attorney was allowed to remove up to three jurors without giving a reason (a peremptory challenge). The plaintiff’s attorney declined this opportunity, but the defense attorney challenged the man whose brother was a lawyer. Then I was the next to go.

I think that it is unfair to force potential jurors to answer such personal questions that have nothing to with the case. The judge’s questions were reasonable for the most part. I think that all Voir Dire questions should limited to those which determine if a juror or someone the juror knows would stand to gain anything by a certain result in the case. Attorneys should not be allowed to choose or reject jurors based on their experiences, occupation, or beliefs. I think it is especially unfair to remove jurors because they have knowledge of some subject, such as science, so that this will be to their advantage if the preponderance of scientific evidence is in favor of the opposing side. I think that peremptory challenges should be limited to one for criminal cases and none for civil cases.
