Amnesty, Illegal Immigration and Border Security

This post is a response to an earlier post by GregJaye.

There should never be amnesty even after the borders are secured. The Constitution forbids all Ex Post Facto laws (at both the federal and state levels). This means that it is illegal to pass a law which would change the punishment for a crime that has already been committed. (It works both ways--you can’t legislatively increase or reduce the punishment.) Immigration law can be changed so that future violators are not punished as harshly, but whatever punishment was prescribed at the time that the violation occurred, must be carried out or else the government is derelict in its duty. The Constitution does give the Congress the authority to restrict immigration.

This does not necessarily mean that there cannot be “a path to citizenship” for illegal immigrants as long as it is allowed by the law that was in place at the time that the violation occurred.

The only other *possible* Constitutional remedy is for the Executive to grant pardons to the violators, but this must be done one at a time. (But I am not sure that the pardoning power that the Framers had in mind really goes as far as we have taken it today.)

I am a believer in freedom for all. I do not believe that crossing a border is evil except in extenuating circumstances (e.g. for security reasons we must keep out violent criminals). I do not believe in punishing people for something that is not evil. (The Bible says that you will be judged by the same measure that you judge other people.) Even though the Constitution gives the Congress the authority to restrict immigration (for virtually any reason), that doesn’t mean that they have to exercise this power for no good reason. There wouldn’t be an illegal immigration problem if immigration hadn’t been made illegal in the first place! If an honest person wants to come to America and give an honest day’s work in exchange for an honest day’s pay, then why not let them do it?

And yes, of course we do need to secure the borders because the Congress is required by the Constitution “to protect the States from invasion”.

The other problem with this issue is "birthplace location citizenship".  This problem is caused by the so called 14th Amendment and by the outrageous interpretation of its phrase "under the jurisdiction thereof".  Requirements for citizenship should be much higher than the requirements to immigrate into the U.S.

Our (Still) Unsecured Borders

Despite wide evidence to the contrary, such as murders of border patrol agents and Americans living along our southern border, continuous drug and human trafficking, our increasingly controversial and unpopular President contends our borders are now secured. He mocks those of us who recognize the truth about our borders as unwilling to recognize his repeated assertion that he has made the borders more secure than they ever have been. He cunningly tries to paint conservatives as wholly anti-immigrants, when we really oppose outright ILLEGAL immigration and strongly support LEGAL immigration.  

 The President repeats over and over the mantra that our borders are secured. He lies. They are not. The borders remain porous. Immigration laws remain essentially unenforced. Sanctuary cities continue to disregard the rule of law. Now his recent campaign speech to his hopeful 'Hispanic base' in Texas was just that, campaign rhetoric, campaign promises.

According to CHPP, Fox News reported, ”A book celebrating suicide bombers has been found in the Arizona desert just north of the U.S. - Mexican border, authorities tell Fox News.

”The book, "In Memory of Our Martyrs," was spotted Tuesday by a U.S. Border Patrol agent out of the Casa Grande substation who was patrolling a route known for smuggling illegal immigrants and drugs.

”Published in Iran, it consists of short biographies of Islamic suicide bombers and other Islamic militants who died carrying out attacks.”

The U.S. Government continues to do little or nothing about our porous border. Who will the government blame when we are hit with another terrorist attack or series of attacks? Will they blame President Bush, who’s been out of office for two years now? The President talked out rebuilding our infrastructure – our bridges and our roads in his SOTU campaign speech. What about securing our borders, Mr. President? National Security is one of the responsibilities of government, not controlling individual citizens’ healthcare, not education, not controlling energy, etc. You are meddling in everything but what you are mandated to do constitutionally. Please reset your priorities right now, before another 9/11 happens, or worse.

Advise to President: Secure the border, enforce the immigration laws, fine and imprison businesses that are thwarting the law, and begin to deport the illegal aliens … stop campaigning and start leading …

Hey, Big Sis, ‘If not now, when?’

Hat tip goes to TeaPartyNation.com for their article, "If not now, when?", which they emailed me. This article clearly delineates the problem of illegal immigration. It discusses the senseless, needless death of another U.S. Border Patrol Agent, Brian Terry, who was murdered last week while on duty.

… He was murdered in the line of duty. He was trailing bandits in the lawless desert area of Arizona. That particular area is lawless because our Federal government will not protect the border or enforce our laws.

Agent Terry was taken back to Detroit to be laid to rest. In what can only be described as a brazen act of Chutzpah, Homeland Security Clown in Chief Janet Napolitano attended the funeral and met with the family.

Under ordinary circumstances, that would be the decent thing to do. Our circumstances are not ordinary.

Agent Terry’s father, Kent Terry told Napolitano to “wake your man up in the White House.” To which Napolitano is reported to have said, he has done more in two years than any other president. I really doubt anyone would have faulted the man for decking her right then and there.

The Terry family has justifiably complained that the government has done nothing to secure the border and by extension, Brian Terry’s death was not only needless but avoidable. They are right.

The media accosted the Clown of Homeland Security after the funeral and asked her about the Terry family’s anger over this. Napolitano said, this isn’t the time to talk about this issue.

If not now, when?

The answer is, the time is never. The Obama regime does not want to talk about this issue. They do not want to talk about the fact they refuse to secure the border. They do not want to talk about the fact they do not enforce our immigration laws. They do not want to talk about the fact they want to grant amnesty to twenty or thirty million illegal aliens, despite the fact Americans overwhelmingly object to this.

This regime does not care about what the American people want.

...the blood of United States Border Patrol Agent Brian Terry and a lot of other Americans is on the hands of Obama, Napolitano and the other members of his regime.

Those are tough words, but the problem is, the Obama regime does not care.

The DREAM Act is a real nightmare!

The DREAM Act is:  Amnesty in disguise; Amnesty lite; Amnesty in your DREAMs; and Amnesty by just another name. This Soetoro/Obama Leftist regime is great at DREAMing up inauspicious names for dreadful legislation. 


According to Politico.com "Obama wants DREAM Act in lame duck (session)."  Simmi Aujla writes in his Political article, "President Barack Obama told Democratic members of Congress Tuesday he wants the DREAM Act passed in the lame duck session as a “down payment” on substantial immigration reform, according to members at the meeting..." The president deceivingly usese terms like "comprehensive immigration 'reform" which is another misnomer, just like comprehensive financial 'reform," health care 'reform' and comprehensive sex 'education' before it ....


He just doesn't get it, does he? He ignores the will of the people and then wonders why he has become such a controversial, divisive figure, as well as becoming increasingly unpopular. It is not that you are not communicating, sir. It is WHAT you are communication is understood by and rejected by the majority of Americans. Yet, you insist, despite the clear repudiation of your agenda a week ago Tuesday, you refuse mend you ways, you still refuse to budge from you destructive socialist agenda. You do so at your and your party's peril. See you at the polls in November 2012!

Both major parties under the leadership of the Bushes, Clinton, and now Soetoro aka Obama are all guilty of dereliction of duty when it comes to border security and enforcing our immigration laws. If this Sheriff is murdered his blood is on the hands of the current occupier of the White House and his cronies in Congress. Enough is enough. Do something, do nothing Congress! Or you will be fired in November.

REMEMBER IN NOVEMBER Congressional neglect of not securing our borders. Let's have no talk of Amnesty or Comprehensive Immigration 'Reform' or any such nonsense until the borders are secured and existing laws are enforced to the jot and tittle.

COMMENT:

Bush, Clinton, Bush, and now Soetoro alias Obama and the major political parties and leadership have all been derelict in their duty to provide security, namely secure borders, on behave of this nation's citizens. They have failed by ignoring their responsibility.

It seems like the government is more interested in meddling or in running automobile companies education, healthcare, and banks, which are not in its jurisdiction, but refuses to provide national security by guarding our borders, which is one its chief duties. Something is wrong with this picture.

It is time for a change in Congress. Remember the border insecurity in November. Fire Congress.

Undocumented Democrats

Undocumented Democrats was another term or description given to illegal aliens (I believe was orignally coined by a caller to the Rush Limbaugh Radio Show). In this deranged and politically correct environment of ours, it has become routine to call or even consider evil good and good evil. Our President and his radical socialist regime have also referred to illegal aliens as Undocumented Workers. They and the previous Bush administration have politically correctly, and I say foolishly and deceitfully, referred to Islamic terrorists as Enemy Combatants.

Calling law-breaking illegal aliens an Undocumented Worker, is like calling one who steals from another (a thief) an Undocumented Burglar. What is the difference? An illegal alien is first and foremost a criminal. By bypassing the legal process of entry into our nation, they have broken the law. They have committed a crime. It sure seems like people are ignoring that truth. They justify the crime by saying that they just want to better their lives. The President compares these illegal immigrants with legal immigrants, which is as false comparison. It is comparing apples and oranges.

It is time to say no to anymore amnesty. We have seen what happens when we permitted amnesty in the past. The border remained unsecured, our laws where not enforced. We cannot believe Congress or our President, because they and he have continuously lied to achieve their goals. They and he must be stopped.

Remember in November – the bailouts, the stimulus, the earmarks, the funding of abortion, the coming healthcare rationing and death panels, granting special rights and privileges to those who practice sexual perversion, and now amnesty – and fire Congress!

FIRST SECURE THE D**N BORDER

A Friday, July 2, 2010 USA Today Newspaper article, “Obama: Move forward on immigration,” records Senator Oren Hatch (R-UT) as saying that the first order of business in regard to immigration is a focus on securing the borders. Hatch states, “When the house is on fire, you don’t try to fix the plumbing. … Hardened criminals, gangs, drug dealers and human traffickers are crossing the border.” Add to that list, Islamic terrorists, though the government is loath to recognize or to mouth those dreaded words regarding those beasts. That is one big problem with the Left’s political correctness gig, denial of reality.

Anyway, I agree with Hatch and other conservatives and Tea Party participants and others who want to protect and preserve the American way of life. We must first secure our borders. We must enforce our existing laws. We must punish employers and illegal aliens who flaunt the law. We do not need any additional laws. What we need is the backbone and the will to do what needs to be done. It is foolish to create another 2,000 page law that commit more money to a problem that calls for a simple straightforward solution: close the borders.

Why not use some of that wasteful stimulus money to fund a wall, border patrol, airplanes, etc. to help secure the border? Is that too practical? Mr. President, you say it might work, and run your chances to get Amnesty. Whose side are you on anyway, Mr. President?

We did not need the healthcare redo that was passed; we do not need the financial ‘reform’ if it does not include Fannie May and Freddie Mac. And we certainly do not need Amnesty. We need jobs, Mr. President. We need to plug the oil leak. We need more, not less oil drilling. We need to secure our borders first and foremost.

THEN ENFORCE THE EXISTING LAWS

Once the borders are secured (LOL), then the current immigration laws should be enforced to the full extent of the law. They have not been enforced for a very long time. Go after the businesses who hire illegals and fine and jail them. Go after the illegals and begin the process of deportation, especially for those that commit additional crimes besides illegal entry.

LEGAL VERSUS ILLEGAL IMMIGRATION, BIG DIFFERENCE!

In his speech the President tried to tie the positives associated with immigration in building our nation, but ignored the fact that there is a distinction between legal immigration, which the majority of previous immigration occurred and illegal immigration, what we have now streaming in from the south and the north. The President is disingenuous when he does this. No, he is deceitful. He will stoop to no ends to get what he wants. Apparently the end – socialistic global Utopian society – justifies the means.

NAE JOINS PRESIDENTIAL BANDWAGON

In an attempt to give the illusion that there is more support for Amnesty than the radical Democratic leadership the President’s backers arranged for people such as National Association of Evangelical President Leith Anderson in support of the Presidents immigration 'reform' to speak at the news conference. Anderson is the man who permitted Richard Cizek to run around America on behalf of the NAE touting creation care, poo pooing homosexuality and abortion.
Cizek resigned after the word of his interview with NPR went viral. Anderson does not speak for me and I imagine few other conservative Christians.

Pitching Amnesty, President Panders to Illegals

I listened to recorded portions of the President’s speech on amnesty for illegals yesterday. Like comprehensive healthcare or comprehensive financial ‘reform,’ so-called comprehensive immigration reform is not about reforming anything. It is solely a selfish political move to expand the President's and the Democratic Party's power and chances in the 2012 Election and beyond. Just like the DISCLOSE Act, which was designed to curb opposition to the Democratic politicians in 2010, Amnesty would further the Democratic Socialistic agenda.

This President is a first-class manipulator and deceiver. In reading his Teleprompted speech, he is essentially priming the pump to introduce amnesty, closeting it in the nebulous high sounding ‘comprehensive immigration reform.’ It is a major component of his socialist, Marxist agenda. Like all his previous initiatives, Americans must be wary of this snake charmer. Look past the words and see his intent and his actions.

This portion of his amnesty speech was of particular interest to me was:

“There are those who argue that we should not move forward with ANY other element of reform until we have fully sealed our borders …” (at 21:54 of the 7/1/10 immigration speech)

Well, sir, I am one of those. SECURE THE D**N BORDER!, FILL THE D**N HOLE! … The fact remains that our borders remain unsecured. I don’t care how long that has been the case. Fix it. That is one thing that we should expect from our government – protection of lives and property. You are failing to do your duty.

Why do you and your agencies continuing to NEGLECT enforcing the laws that are already on the books? Had your administration and previous administrations been doing their job instead of getting your grubby, clumsy hands on our education, healthcare, industries where you have no business, maybe the problem would have reached the concocted “crisis’ that you seem to make a career of lecturing and leeching.

Why do you think it was necessary for AZ and Governor Brewer to pass and sign an law based on the federal law, which you and your bureaucrats and the Bush and Clinton administrations before you chose to ignore as well? Arizona took a stand to do something about the illegal alien invasion of their state and our nation. And you refuse to even acknowledge those invaders, instead referring to them as ‘undocumented workers.’

Why did your agencies stop the raids of businesses employing illegals? Why are you ignoring the present laws? What makes you think we will believe you when you say and new and comprehensive immigration reform law is needed or will be enforced? Hogwash.

Why do we continue to permit babies born of illegals to become American citizens? Let’s change that before introduce any new law.

Enforce existing law and secure the borders before you try to force your politically motivated and self-serving comprehensive immigration 'reform' (better if you used conform) on Americans. We are comprehensively fed up with you and your force fed socialism diet! I comment further on the next sentences of the President's amnesty speech:

“But our borders are just too vast for us to be able to solve the problem only with fences and border patrols. It won’t work. Our borders will no be secured as long as our limited resources are devoted to not only stopping gangs, and potential terrorists, but also one hundred thousand each year simply to find work . . .” (at 22:09 of the immigration speech 7/1/10)

The President just admitted he cannot carry out his responsibilities. It seems to me that he should step aside and let another person do the job then.

Perhaps the President might consider trading jobs with Arizona Governor Jan Brewer. Maybe then you could gain the executive experience that you needs to perform the job as President.

Or maybe some of that yet to be dispersed STIMULUS MONEY could be used to train border guards and pay construction workers to build a fence across the entire southern border? No, because the President DOES NOT WANT A SECURED BORDER!

No ‘comprehensive’ immigration reform (amnesty). We must first and foremost secure our borders. This extreme border insecurity issue is one of the issues we all must remember in November. We need to clean out the House and the Senate. We need real conservatives in Congress. Conservatives who will implement conservative principles. Not John McCain conservatives, which say one thing to get elected, but do something very liberal during the rest of the time in office. Vote out John McCain and the other pro-amnesty members of Congress!
