Keep the Posse Commitatis Act: Oppose S. 1867

Listen to Chuck Michaelis and Barry Sheets discuss the dire implications to unconstitutional provisions in amendments to the latest Defense Authorization Act.  This bill would allow Barack Obama to send any American citizen to Guantanamo Bay at will and indefinitely with no trial and no right to appeal.

'Catch & Release,' Solving the Gitmo 'Detainee' Problem

Barack Obama is Not for Civil Liberties, part 2





One of the things United States has been historically known for throughout its history is its longstanding record of going the extra mile to ensure that innocent parties are not wrongfully convicted or forced to undergo a long and drawn out trial (which can be just as bad as a conviction). In the bill of Rights, five out of the first ten Amendments (4th, 5th, 6th, 7th, and 8th) are for the purpose of placing limitations on the prosecution of the accused. I guess now our good reputation may be gone forever.


The Fifth Amendment to the Constitution reads:


No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.


The Sixth Amendment to the Constitution reads:


In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.


The Eighth Amendment to the Constitution reads:


Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

Notice in the 5th, it says “No person”, not “No citizen”. So there is not an exception to this amendment in the case that someone is from a different country. The exception “except in cases arising in the land or naval forces, or in the Militia, when in actual service" obviously applies to treason cases, not “enemy combatants”. It is understood that a person can be held temporarily until the indictment is served—“to answer for” means to be given a sentence, but the trial must take place "speedily".


These guys like Obama and Bush think that they are above the Constitution and that they fool people with their silver tongues. The constitutional manner of bringing defendants through the usual justice system has worked throughout the history of America. Why change it now? Is it because of the fear of terrorism? It is because whenever a corrupt politician has an opportunity to grab more power, he always does so. And as I pointed out in part 1 and in this piece on Janet Napolitano’s “Rightwing Extremism” Policy, the chickens have now come home to roost. Obama is using extra-constitutional executive powers to persecute ordinary American citizens, not just these terrorists. And has anyone ever thought it odd that Gitmo is in a COMMUNIST COUNTRY?

Democrat and Liberal Insanity on the Rise

(Washington, D.C.) The Democrat leaders and most Democrats in Congress are relentless in their drive for power and in their support of the enemies of America.
They worry more about their Guantanamo detainee than our military trainee . . .

They mistake interrogation techniques for torture and overlook the real torture in Red China, the Sudan, Saudi Arabia against all citizens who dare to believe in Christianity.

They seek surrender instead of victory in the war on terror. They aide and abet the enemies of America. They place roadblock after roadblock in the path of the president in his prosecution of the war on terror.

They restrict nuclear-powered and coal-powered energy development with their foolish concern for the plant life and animal life above their concern for human life. Thus, they are keeping us vulnerable to the crazed dictates of Islamic dictatorial states.

They are for eliminating the death penalty even for the worst of criminals. Yet they support abortionists and the abortion industry who are for snuffing out the lives of innocent babies by the millions before they are even born. They favor creating and destroying life for the “hope” of saving a life.

Internal Terrorist Internment, Too


President Franklin D. Roosevelt did it to the Japanese in World War II. President Bush should consider sending the 218 representatives, who voted to require that the troops be brought home from the war on terror in Iraq by next September, to an interment camp. While President Bush is at it he might think about hauling off along with the cowardly congressmen and congresswomen, more than a few traitorous senators like Kennedy and Schumer. They work tirelessly constructing roadblocks to victory (and detours to defeat) at every step along the way in this war on terror. Many in the Congress are every bit the enemies of America as the mullahs or imams, They are internal terrorists and should be locked up for the duration of the war on terror to protect America from all of their treachery. The wicked make mischief by law. There is much mischief-making in Congress these days.

Guantanamo Bay Cuba may be an excellent venue to place these lovers of capitulation. These folks seem to have more in common with the residents of Gitmo than the residents of Middle America. They could have a chance to really get to know their brother, with whom they apparently have more in common with than the typical American citizen. Yes, pair up Abdul and Conyers, Mohammed and Murtha, Hassid and Hoyer; they would have just one big meeting of the minds.

The Democrat Party has so brainwashed (or maybe) bribed these politicians so that they are willing to do things that are reprehensible. Personally, I would much rather be fighting the war on terror in the Middle East than in Middle America.
