John Freshwater is sued for living out his Christianity

Righting 1st Amendment Wrongs

Here are some of the details of the case filed against Mr. Freshwater in Federal District Court last week.

(Mount Vernon, Ohio) A federal civil rights lawsuit was filed in the Ohio Southern District Federal Court on Friday, June 13th (apropos) by a local family on behalf their middle school son. The legal action alleges civil rights violations by the Mount Vernon City School District Board of Education, superintendent Stephen Short, middle school principal William White and science teacher John Freshwater.

The most galling aspect of the lawsuit, as I read a reference to it in the Mount Vernon News, was the following sentence.


Freshwater’s action and the administration’s inaction, the lawsuit states, “have the purpose and effect of endorsing religion over non-religion and Christianity over other religious beliefs, thus violating the neutrality portion of the Establishment Clause.”

I could not believe what I was reading so I looked up again the first amendment to the U.S. Constitution, which reads:

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech . . .

What in the world is the neutrality portion of the Establishment Clause? Is it the word “no”? I do see where CONGRESS shall not make any laws establishing or sanctioning a particular denomination (like the Baptists or the Presbyterians or the Methodists) as a state religion, but it baffles me as to what basis the family’s attorney’s (probably back by the wildly un-American ACLU attorneys) make that very false allegation. I guess anyone can file a suit for anything. This is a frivolous lawsuit in my eyes. It is only meant to intimidate School Boards, Principals and Teacher to obey the creed and precepts of the Secular Humanist Man-is-god religion.

Those tyrannical perverts of justice, activist judges, have twisted and manipulated the simple and clear words of the constitution to mean something that the founders never intended it to mean.

Simply, the framers of our constitution and our founders wanted to prohibit the United States Congress from making any law that would sanction a particular denomination as was done England with the Church of England, which in essence was a state church. The first clause of the First Amendment, the establishment cause, dealt with that congressional prohibition. It was never intended, as it is applied today to purge God and all godly and Christian influence from our schools and our society.

The free expression clause was intended to protect the rights of the individual to express his faith or beliefs anywhere and at anytime. And what about John Freshwater's right to freedom of speech? Must he give that up when he becomes employed in the government-Secular Humanist dominated school?

Essentially the first clause (establishment clause) of the First Amendment has been twisted to mean something it was never meant. The second clause (free exercise clause) and third clause (freedom of speech) are put aside and virtually ignored.


A misinterpretation of the U.S. Constitution is now being used to strip Christians from their freedoms instead of protecting them as originally intended. In other words, it is now being used to silence Christians like John Freshwater. It is now being used to intimidate School Boards, Superintendents, Principals and Teachers into succumbing or conforming to the devilish doctrine of the ACLU and the high priests and priestesses of the Secular-Humanistic religion instead of standing on traditional values and principle.

I would like to see a counter suit filed using this as a test case and once and for all return sense to the constitution and defeat the misnomer that Christianity is anathema in education and in American society.

Please seriously consider supporting Mr. Freshwater with a check for his legal expenses as he tries to defend himself. He dared to live by his Judeo-Christians principles, and that apparently offended someone. Too bad, the leftists need to just get over it. There is a lot that offends me, but I don't go around suing people every time I'm offended.

Maybe this could just be the case that sets a precedent, that turns things around as far as the leftist tilt of our nation. We are, unfortunately, tilting to the brink of extinction.

    Are you aware that Freshwater burned a cross onto the kid whose parents are suing him? Is that proper Christian behavior now?

    Freshwater did not brand a cross in the students arm. This may shock you, but Tesla coils used to show electric current. They are often used in classroom as a teaching tool . . . That is what John Freshwater was using. He apparently was not following the instructions from the manufacturer because that device should not "burn" the skin.

    The press (biased liberal media is making this guy out to some sort of a monster, which he is not. He was the 2007 Teacher of the year and a 21 year veteran of the Mount Vernon City Schools - well loved by his students.

    Like Gitmo the leftist media will attack anything that might get in the way of their agenda.

    Wow. It's amazing how many small minds you can fit into a small town.

    This is not simply a case of "intelligent design" vs. evolution. This teacher stepped way beyond the borders of this legitimate debate and took it upon himself to deliver the condemnation of students who did not share his personal interpretation of countless other Biblical issues, as well.

    How dare a public school teacher demean and demonize students who may be gay or lesbian by imposing his own slanted religious beliefs in a public classroom?

    Did this teacher just pick and choose what he liked from the Bible ... or did he also condemn - as the Bible clearly states should be done - those who eat shrimp? ... or get divorced? ... or a multitude of other "abominations"?

    Look beyond the borders of your small town. There's a big, wide world out there.

    And if you don't believe in science ... don't be a science teacher.

    And if you find the need to ignorantly condemn others as having "chosen" to be "sinners" by being gay or lesbian ... most certainly DON'T be a public school teacher of vulnerable youth. Go be a preacher of hate for some radical religion.

    I definitely don't want you teaching MY child in a public school...

  5. I'm with the Anons as well as eddie geffen here. Mr Jaye, do you really think that Freshwater's activities "burst on the scene" just earlier this spring? A report from five years ago at a site called answersingenesis.org details a complaint against Freshwater by a former student as well as an actual proposal made to the school district by Freshwater, all of this dealing with his wanting to teach "creation science" Specifically, he was called to a meeting over the complaint which dealt with his teaching of "flaws in evolutionary theory" (as AIG puts it) to his eight grade science class.

    As this report indicates, John Freshwater was already agitating and challenging the public school curriculum regarding science, or rather being complained about for doing so as early as May 2003. Since 2003 this man has been an 'activist teacher' causing as much trouble as he could and butting up against the rules of the school district employing him with the sole purpose of finally gaining attention on a national scale, something which the more extremist movement within Fundamentalist Christianity (Christian Theocrats, I'd rather they be called) all seem to want to do. To bring these matters to a level where they can make it into the courts and challenge our laws. This guy is no different than Ward Churchill IMHO, teaching views and opinions that are offensive (though each man is on a thoroughly different "side" in the "culture wars", obviously) to captive audiences while being on the taxpayers' payroll.

    And let's not forget, this guy agitated for at least 5 years and then finally had to brand students' arms with crosses to get the national attention he sought. A rather desperate move there it would seem to me.

    You say a counter-suit would be a "test case" in terms of returning to Christians rights they have in your opinion "been stripped of"? I see this as nothing more than an attempt by an "activist teacher" (rather than your "activist judges" claim) to bully his way into just such a lawsuit with hope to set a dangerous precedent for all of us. The "rights of Christians stripped away"? What about the rights of the students being told that evolutionary biology is wrong as well as homosexuality based on a sola Scriptura interpretation of The Bible? Our children have rights as well, rights to not be evangelized to in their science classes!

    And yes, I AM a Christian, and as far as I'm concerned, people like John Freshwater do nothing but attempt to make the rest of us Believers look like idiots to the rest of the U.S. Though from a comment I found by a student (though I've not yet confirmed it), Mr Freshwater appears to be one of these "true/real Christians" who considers Roman Catholics to not be Christian at all, so good riddance to bad rubbish as far as I'm concerned.
